RULES OF THE BOARD OF FIRE COMMISSIONERS
ELBURN AND COUNTRYSIDE FIRE PROTECTION DISTRICT
Source of Authority
The Board of Fire Commissioners of the
Elburn and Countryside Fire Protection
District pursuant to power and
authority derived from the
Fire Protection District Act" (70 ILCS 705/16.01 et seq.)
and the Board of Fire and Police Commissioners Act (65
ILCS 5/10-2.1-1 et seq., as well as other applicable
State and federal statutes, common law, and the State and
federal constitutions.
Board of Fire Commissioners
The scope of duties of the Board of Fire Commissioners shall
generally include:
Establishing policies for recruiting, testing, selection, and
promotion for all members covered under its authority.
Establishing guidelines and procedures for hearings required for
discipline and termination of members of the District covered by
its authority. Serving as an appeals board or hearing board for
District members disciplined or terminated under guidelines
established by these rules.
The Board shall have such other powers and duties as are given
it by the statutes of the State of
Illinois.
Membership
The Board of Fire Commissioners is made up of three members
appointed by the Board of Trustees. Each Commissioner holds a
term of three years.
Officers of the Board of Trustees and their Duties
Each year at the Board of Trustees meeting in June, the Board of
Trustees appoints a Fire Commissioner. The Board of Fire
Commissioner shall annually elect a Chairperson and a Secretary
during the first meeting each
fiscal year. The Chairperson shall be the presiding officer at
all meetings. The
Secretary shall assist the Board by preparing all
correspondence, keeping records,
assisting in the testing
process, and performing other duties as assigned by the Board.
The Secretary shall keep the minutes of all meetings of
the Board in a permanent record book and shall be the custodian
of all the forms, papers, books, records, and completed
examinations of the Board,
and shall perform all other duties the Board prescribes. (70
ILCS 705/16.02)
Meetings
Regular Meetings
Regular meetings of the Board shall be held quarterly or as
determined
necessary by the members of the Board. At the beginning of each
calendar year, the Board shall prepare and make available a
schedule of all its regular meetings, listing the times and
places of such meetings. Meetings shall be held and notice of
the meetings shall be given in accordance with the Illinois Open
Meetings Act (5 ILCS 120/1 et seq.).
Special Meetings
Special Meetings are open to the public. The Administrative
Assistant posts written notice with the agenda forty-eight hours
prior to the scheduled meeting. This notice contains a brief
statement of the business to be submitted for the consideration
by the Board, and will set forth the time and place of the
meeting. (5 ILCS 120/2.02(a))
Closed Sessions
During any regular or special meeting, a closed session may be held for
any purpose
upon a proper motion, made by any member of the Board. These
meetings can be called for any reason set forth in 5 ILCS 120/2
or any other reason authorized by law.
Closed
sessions may be limited to
Commissioners and such invited persons as the
Board may
deem necessary. The Secretary will record the motion to close
the meeting, record the roll call vote of the Commissioners on
said motion, and keep minutes of the closed session. (5 ILCS
120/2 and 2a)
Quorum
A majority of the Board constitute a quorum for the conduct of
all business. All meetings are only held with a quorum of the
Board present.
